There are huge numbers of non-Muslims living in the UAE who might face the same legal issues as Muslims. These conflicts usually involve money, parenting decisions, marriage choices, inheritance, child custody, or business shares. When non-Muslim couples file for divorce, they need a legal framework to define the custody conflicts among them. To resolve such matters, the UAE has made a separate legal framework to make sure the conflicts are handled professionally without favoring any party.

Under the law termed as Federal Decree Law No. 41 of 2022 on Civil Personal Status for Non-Muslims, families can now seek legal help of custody and inheritance. Non-Muslim families can get legal assistance from the legal advisors to get the required assistance in preparing the rightful documentation for the custody battles in the UAE courts.

UAE Legislation Governing Child Custody Cases

The UAE government has made special legislation for the families of non-Muslims, focusing on humanity and justice. Before the special legislation, non-Muslims were used to fight under the Muslim law, since it involved the legal complications related to religion; the Government decided to make a separate law for non-Muslims.

The flexibility of the law allows the parents to either use the law of their own country, where they belong, or the laws of the UAE, to get custody of their child.

How UAE Civil Courts Apply Federal Laws

Non-Muslim families can now get their cases completed under the civil courts. This remarkable step was achieved when federal laws separated the non-Muslim family disputes from the Muslims family law.

Federal laws are introduced for non-Muslims as per their home country’s law or the religion they follow.

Family custody Disputes under UAE Laws

Cases of family disputes may arise once the parents of the child decide to separate or get divorced. The custody cases go to UAE courts, where a judge evaluates the cases, considering the child’s age, emotional needs, financial needs, and other related matters. Once the evaluation is completed, the custody of the child is granted to the person who deserves it the most. In child custody cases, the civil court in the UAE follows a child-centric approach, and decisions are made for the child’s welfare, ensuring mental and physical health.

How UAE Courts Consider Child Welfare in Custody Disputes

Once the case is forwarded to the courts, the judge evaluates the parenting capability and character of both parents, considering the top priority of the child’s welfare. Once the capability is judged, the judge grants custody to the deserving parent.

What kind of custody can a judge allow?

UAE family laws define the two major custody types for the parents: physical custody and legal guardianship. Physical custody means where the child will physically live, and legal guardianship means who can decide the education, food, travel, and other major decisions for the child.

According to UAE civil laws, even after divorce and child custody, both parents have to take decision mutually for the kid, parent cannot decide the child’s lifestyle, education, travelling individually. It is also important for both parents to finalize any decision; they have to discuss with the child welfare department, which is usually kept involved once parents are separated in the UAE.

Parental Duties Following a Custody Decision

In today’s world, the courts and judges allow the parents to share the guardianship and other parenting responsibilities, which can help to shape the child’s future.

According to UAE law, one parent can get child custody and will be responsible for the lifestyle, food, and health. The other parent is responsible for the finances and education of the child. UAE family law gives freedom to parents to make mutual decisions, and they can also file an application to get legal help under their home country’s laws.

    Legal procedures required to follow

To start the process, it is necessary to file the complaints, where the police or the relevant authority review the cases. Once the case is reviewed, it is then forwarded for the hearing process. Once the case is evaluated properly, it is then forwarded for the final ruling. Since such cases involve complications regarding emotional and financial issues, it becomes very necessary to get the required and desired help from legal advisors. Legal advisors can help in reducing complicated family disputes.

How Family Courts Handle Family Disputes in the UAE

Judges often appointed are highly qualified in dealing with emotional and sensitive family cases that involve the welfare of the child.

    Out-of-court settlements

To avoid the complication of the cases, the court often encourages the person to go for the out of the courts settlements of the cases that can be settled before it goes for the final verdict.

This step can save parents from spending money and time, and it can prove to be the best and most effective method for the mental state of the child as well.

    How it helps the child

Any decision made from anger may not be beneficial for the child. Mediation often helps in the child’s mental health as well.

    Foreigners Custody cases

In many cases, parents do not belong to the UAE originally or even have different nationalities; in such cases, UAE courts have to follow international laws before it makes the rightful verdict.

In some cases, one of the parents may want to relocate to another country, which may require a change in the verdict, and it becomes very important for the government to follow the laws of internal courts.

Travel Restrictions in Child Custody Cases

In some cases, when one parent decides to move out to another country, the court may restrict the child from moving out with that parent. To save the case for the person who is residing in the UAE, UAE laws may impose the restriction of traveling.

Why Legal Advice Matters in Custody Disputes

Legal advisors and lawyers can help parents in custody cases. They prepare the right documentation for the court’s hearing, specify the legal direction, defend the cases in courts, and because of that, they can make the case go in their direction if the right legal help is taken.
